Establishing Guardianship for an Individual with Disabilities
Parents of a child with a disability often assume that they may continue to make decisions for their child even after he or she turns 18. However, once an individual turns 18 in New York, no other person has the authority to make personal, medical and/or financial decisions for that person. In order to obtain the legal authority to make decisions for an adult under a developmental disability, a guardianship proceeding is required.
